Propose of the Addendum:

As per pre-bid meeting of Herat and Kandahar silos package which took place on November 17, 2019, most of the companies requested the below changes. In order, to be able to participate in bid opening.

Paragraph 2.7 Subcontractors:

Note: Sub-contractor must meet the following requirements of sub-contracted parts of the contract:

  • Similar contract in construction of (Civil Work): 90%
  • Annual turnover: 110%
  • Available balance: 30%
  • At least one similar contract in construction of site plan civil work, utilities and facilities of site plan in the last 5 years

“Subcontractor” means any person named in the Contract as a Subcontractor, or any person appointed as a subcontractor, for a part of the Works; and the legal successors in title to each of these persons.

“Contractor’s Personnel” means the Contractor’s Representative and all personnel whom the Contractor utilizes on Site, who may include the staff, labor and other employees of the Contractor and of each Subcontractor; and any other personnel assisting the Contractor in the execution of the Works.

The Contractor shall not subcontract the whole of the Works.

The Contractor shall be responsible for the acts or defaults of any Subcontractor, his agents or employees.

The Contractor shall not be required to obtain consent to suppliers solely of Materials, or to a subcontract for which the Subcontractor is named in the Contract

The Contractor shall introduce not less than 7 days’ from notice to proceed each Subcontractor to mail. The Payment will be executed only for Main contractor after approval of MAIL/SGR technical team to which includes an amount payable to a nominated Subcontractor is executable through Main contractor. 

The Contractor is responsible for all activities addressed to all the Site staff and labor (including all the Contractor's employees, Subcontractors and any other Contractor’s personnel, and all truck drivers and crew making deliveries to Site for construction activities as well as concerning the risks and dangers

Failure to comply with this requirement will result in rejection of the subcontractor.

In the case of a Bidder who offers to supply and install major items of supply under the contract that the Bidder did not manufacture or otherwise produce, the Bidder shall provide the manufacturer’s authorization, using the form provided in Section IV, showing that the Bidder has been duly authorized by the manufacturer or producer of the related plant and equipment or component to supply and install that item in the Employer’s Country. The Bidder is responsible for ensuring that the manufacturer or producer complies with the requirements of ITB 4 and 5 and meets the minimum criteria listed above for that item.

In case of Having Sub-contractor:

If any Subcontractor is entitled under any contract or agreement relating to the Works, the bidders are obliged to introduce their subcontractor in the proposal during bid opening.

Evidence of Payments for subcontractor:

Before issuing a Payment Certificate which includes an amount payable to a nominated Subcontractor, the Engineer may request the Contractor to supply reasonable evidence that the nominated Subcontractor has received all amounts due in accordance with previous Payment Certificates.
